Legal Remedy for Recovering Loan Payment from Absconding Friend

My family is having a problem. My father paid 3 lakhs to his friend for business work in 2017. Which he promised to repay later. But he is currently not giving the money. Thus he took money from many people for business. But none could repay. He is currently absconding. And we have all the proof of payment. My father’s only savings is now. Is there any legal remedy for this matter? So that we can get the money back?

Answer:
If you have sufficient evidence of the loan and the agreement made between your father and his friend, you can approach the civil court and file a case for the recovery of the loan. You can file a lawsuit for recovery of the 3 lakh taka and prove that the loan was agreed upon with a promise to repay. If your father’s friend is absconding, the court can issue a summons to him, and after an unsuccessful attempt to reach him, the court might proceed with the case in his absence. Additionally, if the amount is large enough, you can pursue this matter through a money recovery suit, and the court might also order for the garnishment of his property or assets, should there be any, to recover the owed amount. If fraud or misrepresentation is involved, a criminal case for fraud might also be an option.
