Legal Issue: Property Transfer Among Siblings without Father

Question

We are four siblings with no father and a mother. Our concern is, if our mother is not alive, will her property go to her siblings? They have taken it from our father, and now our mother wants to transfer the house in her name. We, the four siblings, do not agree, and we want to give her a different place. Then she can sell it and keep the money in the bank. What is the correct way to proceed?

Answer

As you have no brother, your mother will inherit 1/8 of your father’s property, while you and your four sisters will inherit 2/3 of the remaining property. Your uncle, Fupura, will receive a 5/24 share of the property. Your uncles are not entitled to your mother’s property, but if your uncle dies, his share will go to his spouse. To ensure ownership of the property, register it under your mother’s name and give her a non-revocable power of attorney. This way, your mother will have control over the property during her lifetime, and you and your sisters will inherit it legally after her passing.
