Inheritance Rights After Father’s Death If Property is in Father’s Name

We are 1 brother and 1 sister. My grandfather wrote all his property to my father and uncles. Now, my grandfather has passed away, and the property is in my father’s name. If my father dies, will the property go to my uncle and their families?


Answer:

In this case, the inheritance of your father’s property depends on the applicable inheritance laws in Bangladesh, which are based on your religion (for example, Muslim, Hindu, etc.).

1. If You Are Under Muslim Law:

  • Your father inherited the property from your grandfather, and it was transferred to his name.
  • When your father dies, his property will be distributed among his legal heirs, which typically include:
    • His wife (your mother)
    • You and your sibling
    • His brothers (your uncles)
  • Under Muslim inheritance law, sons receive twice the share of daughters. So, if you and your sibling are his only children, each of you would get an equal share of his property.
  • Your uncles (your father’s brothers) would not automatically inherit your father’s property. It will be distributed according to the Islamic inheritance system, and they will inherit from your grandfather’s estate, not your father’s.

2. If You Are Under Hindu Law:

  • Your father’s property would be considered self-acquired.
  • When your father dies, it will be divided among his legal heirs, including his wife and children (you and your sibling). Your uncles (father’s brothers) will not inherit your father’s property.
  • The property will be shared equally among you, your sibling, and your mother.
  • The in-laws (your uncles’ families) will not inherit the property unless specifically included in a will.
