Dealing with Land Sale Attempts by Heirs

My father bought a 40 Shatangsha (1 Shatanghs means 435 Sq. Ft) share of land from 4 co-owners in 2011. One of them was a minor, represented by his mother and grandmother in the deed. During a recent survey, the land record showed the names of the original owners. Now, after 2 years of becoming an adult, the minor is trying to sell the land. What can be done in this situation? Currently, the land is in our possession.

In the context of purchasing a minor’s land, a legal guardian should have been appointed for the minor to prevent any future complications. In this case, the legal guardian was the minor’s father, with the mother/grandmother being only the custodian of the minor. Without a father, anyone could obtain court permission to sell the property. If the property was registered in the name of the minor’s father in 2011, there should be no issues. However, it is advisable to seek the advice of a knowledgeable civil lawyer.
