Question
During a business transaction, a client in Dhaka deposited a check of 14 lakh taka. It was agreed to pay in cash before the due date, but it was not done. When the bank was approached with the check, they reported no funds in the account. The client is not receiving calls and their exact address is unknown, possibly in Banani or Gulshan area. What should be done in this situation?
Answer
Go to the bank and request to dishonor the check and submit other necessary documents including the customer’s address. You can obtain the address and other information from the bank. After dishonoring the check, a legal notice should be sent by a lawyer, and after 30 days of providing the legal notice, file a case under Section 138 of The Negotiable Instrument Act 1881.
