Can you legally take back a shop after the lease has expired?

My helpless uncle rented a shop to someone with a security deposit of 30,000 Tk for five years. Now, the lease has expired three years ago, and my uncle is asking for his money back to take the shop. However, the tenant is refusing to give back the money and threatening to produce a document (dalil) that says my uncle can’t take the shop. The document will state that they won’t give the shop to anyone else except my uncle. Can we seek legal assistance now?

In this case, you can seek help from the police for eviction, and try to negotiate through mediation. If unsuccessful, you can file an eviction case in court, but first, a legal notice must be served, and a written agreement and notice are mandatory for filing the case.
